2023 GENERAL TERMS AND CONDITIONS FOR SALES

Any order entails full acceptance by the Buyer of the general terms and conditions, as set out below.

The prices set out are exclusive of taxes and delivery fees.
In addition, V.A.T. is charged at rates of 20%, 10% or 5.5%, based on the services ordered.

Minimum order per delivery: €100

– 3 –
In order to be taken into account, any order must be placed in writing, signed by the Buyer.
Any order of less than €500 (taxes excluded) must be fully paid for before the service is provided.
When any order of more than €500 (taxes excluded) is made, a deposit of an equal amount to 50 % of the total price (VAT included) must be paid; this amount is equal to 100 % for customers outside of the French zone and can only be paid via bank transfer.
Any cancellation by the Buyer of an order or an accepted reservation results in the loss of the deposit as a one-off compensation payment.
Any possible bank transfer fees will be charged to the Buyer.

The liability of the company … (La Maison Poirier) shall not be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale is due to a force majeure event. As such, force majeure shall mean any unforeseeable and irresistible external event within the meaning of Article 1148 of the French Civil Code (Code Civil).

The Chef’s suggestions are subject to change depending on seasonality and availability of products.

La Maison Poirier offers a wide range of products and services taking into account the differents modes of consumption. The Taker is solely responsible for the proper respect of the sanitary protocol in force set up by the government and by the possible strengthening of sanitary instructions required by the organiser of the event / exhibition concerned.

Settlement: net after submission of the invoice. Our invoices are made out using the prices in effect at the time of delivery. Penalties for late payments: 3 times the legal interest rate.

For Cocktail Events and Receptions with less than 500 guests, the Buyer will conclusively make his choice in writing about the food service and the final number of people within 5 working days of the date of the event. This number will be used as the minimum invoicing amount, even if the number of attendees is lower on the date of the event.
All other products in our catalogue can be ordered before 5:00pm, the day before the predict delivery day.

Cancellation of Catering products: in the case of products which, by their nature, cannot be returned, or may deteriorate or expire quickly, the Buyer may not enjoy a cancellation right under Article L 121-20-2 of the French Consumer Code. In this way, any cancellation of service or order within 7 clear days before the beginning of the event (installation, set-up, building period, …included) leads to the full payment of the customer order.

Delivery service
12% of the amount (taxes excluded) for exhibition showrooms in the Parisian Region: Porte de Versailles,
Villepinte, le Bourget, CNIT, Espace Grande Arche, Porte Maillot and Espace Champerret.

Delivery times are given based on 90-minute time slots. They may be delayed based on unforeseen events that fall out of our company’s control, including strikes, unusual levels of traffic, weather conditions and works.
Any potential delays do not entitle customers to cancel orders, refuse goods or claim damages and interest.
Poirier shall only take into account reservations made by the customer upon delivery and appearing on the duly signed delivery slip.

Our hire prices cover the entire duration of an exhibition or a maximum period of 15 days.
Any use that is longer than the use period set out in the quote must be subject to special agreements.
The hirer is responsible for the equipment that he hires from its delivery to its collection. If it is stolen or damaged, the amount to replace or repair it shall be invoiced to him.
The final purchase order for hiring will be recorded upon receiving payment for the total amount of the hire price. Customers will be asked to pay a deposit.

Returns of non-perishable goods: possible under certain conditions, except for those ordered in a specific way, which do not appear in our catalogue.

2023 prices, which may be amended based on changes to suppliers’ terms and conditions.

Any objections to the interpretation and execution of these general terms and conditions shall fall within the exclusive competence of the Court of Versailles.
